1. General Information
- 1.1. These Terms of Use define the rules for using the PayEye website and services, available at www.payeye.com.
- 1.2. The Terms apply to both individual (B2C) and business (B2B) users, in Poland, EU countries, and internationally.
- 1.3. Acceptance of these Terms is required to use the services provided by PayEye.
2. Service Provider
- 2.1. The services are provided by:

3. Scope of Services
- 3.1. PayEye offers digital biometric and vision-based identification and payment services.
- 3.2. Services may include paid or free access, subject to specific terms, subscription models, or business agreements.
- 3.3. Services are available to:
- a) consumers – individuals aged 18 and above,
- b) business clients – companies, sole proprietors, institutions.
4. Account Registration
- 4.1. To access certain services, users must create an account and provide accurate data.
- 4.2. The user is responsible for safeguarding login credentials and for actions taken under their account.
5. Business Clients
- 5.1. Business clients may be subject to additional contractual terms and licensing.
- 5.2. Business use of PayEye solutions (e.g., API, SDK) requires a separate commercial agreement.
- 5.3. Business clients agree to:
- a) provide lawful use cases,
- b) comply with data protection regulations,
- c) obtain proper consents from end users.
6. User Obligations
- 6.1. Users must not:
- a) provide false data,,
- b) use the platform unlawfully,
- c) interfere with system security or integrity
- d) resell services without consent.
7. Intellectual Property
- 7.1. All materials, trademarks, and software are the property of PayEye or its licensors.
- 7.2. Users receive a limited, non-exclusive, non-transferable license to use the platform.
- 7.3. No rights are granted to copy, reverse engineer, or distribute any part of the service without written consent.
8. Fees and Payments
- 8.1. Some services may require payment (e.g., subscription, integration)
- 8.2. Business clients may receive individual pricing and invoicing terms.
- 8.3. All prices are provided net of VAT unless otherwise stated.
9. Liability
- 9.1. PayEye is not liable for:
- a) actions taken by users contrary to the Terms
- b) third-party service outages
- c) force majeure events
- 9.2. For business users, PayEye’s liability is limited to the value of the services provided under the relevant agreement.
10.Data Protection
- 10.1. PayEye processes personal data in accordance with its Privacy Policy.
- 10.2. Users are obligated to comply with data protection laws when acting as independent controllers (e.g., business clients).
11.Termination
- 11.1. Users may delete their account at any time.
- 11.2. PayEye may suspend or terminate access in case of:
- a) breach of the Terms,
- b) illegal activity
- c) request from authorities.
12. Amendments to the Terms
- 12.1. PayEye may update these Terms at any time.
- 12.2. Users will be notified of material changes in advance.
- 12.3. Continued use of the platform means acceptance of updated Terms.
13. Applicable Law and Jurisdiction
- 13.1. These Terms are governed by Polish law.
- 13.2. For consumers – disputes may be resolved by competent courts based on residence..
- 13.3. For business clients – any disputes will be resolved by the court competent for the registered office of PayEye.

15. Changes to the Terms
- 15.1. The Terms of Use are continuously reviewed and updated as necessary. The current version of the Terms of Use was adopted and has been effective since 01.08.2025.
